Businesses do not benefit from prolonged litigation. The process is expensive, time-consuming and uncertain. While litigation remains a valid option for some commercial disputes it is not the right tool in the majority of cases.
What is required is a more collaborative and less adversarial resolution model that better suits the interests and needs of commercial parties. This model provides for the early resolution of disputes, thereby freeing up the parties to focus on their businesses and the future, not yesterday's problems. However, this requires a different skill-set and approach to the traditional adversarial model.
Negotiating the Trans Pacific Partnership - implications for governance

New Zealand is one of twelve countries negotiating the Trans Pacific Partnership (TPP). Styled as a twenty-first century trade agreement, TPP has aroused considerable interest on the part of business and opposition on the part of some groups concerned about the impact on the domestic economy. Former trade official, diplomat and industry association CEO Stephen Jacobi is following these negotiations closely. He will put these negotiations in context and trace a number of important implications for governance.
