Businesses do not benefit from prolonged litigation. The process is expensive, time-consuming and uncertain. While litigation remains a valid option for some commercial disputes it is not the right tool in the majority of cases. 

What is required is a more collaborative and less adversarial resolution model that better suits the interests and needs of commercial parties. This model provides for the early resolution of disputes, thereby freeing up the parties to focus on their businesses and the future, not yesterday's problems. However, this requires a different skill-set and approach to the traditional adversarial model.
