Mainzeal and Directors Liability – A Cautionary Tale

The Supreme Court decision released in August brought the Mainzeal saga to an end by holding the directors liable and awarding compensation of $39.8 million (plus 10 years of interest).

The decision also provides practical guidance for directors, within the limits of the existing legislation, and calls for a review of our insolvent trading laws.

This case serves as a warning for other directors and those aspiring to be directors.

Matt Kersey
